Russian Government Defines Criteria for Unused Dacha Land

The Russian government has established specific criteria for identifying unused dacha land, outlining conditions that could lead to land being classified as neglected. Prime Minister Mikhail Mishustin signed the corresponding decree, which was officially published on the legal information portal. This decree aims to ensure that dacha land is properly maintained and utilized.

According to the new regulations, dacha land can be classified as unused if more than 50% of the plot is contaminated with waste or debris that has not been cleared for at least a year. Furthermore, land intended for construction will be considered unused if no buildings have been erected within a five-year period, with a seven-year allowance for private houses.

Other indicators of “undeveloped” land include the presence of dilapidated buildings with collapsed roofs and broken windows that remain unrepaired for a year or more. Additionally, household, garden, and vegetable garden plots will be deemed undeveloped if weeds exceeding one meter in height cover more than half of the land.

It is important to note that these requirements will not apply to plots where usage is impossible due to natural disasters or legal restrictions, such as arrest. These exceptions acknowledge circumstances beyond the owner’s control that may prevent land maintenance.

Owners of plots identified as violating these regulations will be granted a three-year period to rectify the issues and bring their land into compliance. This grace period allows owners time to address the problems and avoid potential penalties or further action.

The decree is scheduled to take effect on September 1st. This implementation date provides landowners with a clear timeline to understand and comply with the new requirements for dacha land usage and maintenance.
