Fallen Tree Damages Cars: What to Do

A large tree has fallen, damaging parked cars, and residents are advised to take precautions and know their rights. The incident highlights the steps to take when a tree falls on a vehicle.

Immediately after a tree falls on a parked car, it’s crucial to document the scene thoroughly. Avoid moving any debris or branches until you have recorded all relevant details.

The first step is to contact the police by dialing 102 from your mobile phone. The responding officer will create a report detailing the time, location, and damages to the car, including a diagram of the incident. This police report is essential and will include a decision to refuse to initiate a criminal case, which is needed for further action.

Next, take extensive photos and videos of the scene. Capture the fallen tree on the car, the car’s position relative to the surrounding area (street, house number, store name), and a general overview of the location. Gather contact information from potential witnesses and check for nearby surveillance cameras.

Determining who is responsible for the fallen tree is critical for obtaining compensation. If the car was parked in an apartment building courtyard, the management company responsible for maintaining the property is liable. If the tree was on public land, the local administration or a contractor hired for landscaping and tree maintenance is responsible.

While OSAGO insurance won’t cover this type of damage, comprehensive insurance (CASCO) might provide coverage if the policy includes tree falls as a covered event. Review your policy carefully to confirm.

To seek compensation, you will need several documents.
