Clarification on Leaving the Scene of an Accident Without Liability

The Supreme Court of the Russian Federation has clarified that a driver can leave the scene of an accident to avoid obstructing traffic without being held liable for leaving the scene. This ruling stems from a case involving a Moscow resident who was initially penalized for moving her car after an accident.

The court overturned the decisions of lower courts, acknowledging the woman’s actions as lawful because she moved her car to prevent a traffic jam on a major thoroughfare and did not attempt to conceal her involvement. Consequently, the violation was reclassified, resulting in a fine instead of the loss of her driver’s license.

An expert emphasized that traffic regulations mandate drivers to move their vehicles if they impede other traffic. Such action is not considered leaving the scene of an accident.

To safeguard themselves, drivers are advised to document the scene before moving their vehicles. This includes taking photographs, creating a diagram, and obtaining the signature of the other party involved, if possible.

Drivers should also contact emergency services to report the incident. This provides further evidence that the driver was not attempting to flee. Leaving the scene is also permissible in certain emergency situations, such as needing to transport an injured person to the hospital or to catch a flight.
