Conflict Between Bailiffs and Residents Continues in Verkhnyaya Pyshma

Enforcement proceedings have been resumed against a family in Verkhnyaya Pyshma despite their debts being fully paid, leading to renewed conflict with bailiffs. The situation stems from the controversial sale of the Klimov family’s apartment in 2023, which occurred without their knowledge to settle a debt initially owed to Binbank and later acquired by the Yugoria collection agency.

The family’s lawyer, Zarina Adyeva, reports that three enforcement proceedings have been restarted, resulting in frozen accounts, travel restrictions, and property seizures. These actions are occurring even though Elena Klimova has received confirmation from both the management company and the bank that she has no outstanding debts. The lawyer has challenged the legality of the resumed proceedings in court.

The apartment was initially sold at auction after previous attempts failed to attract buyers. Bailiffs then transferred the property to collectors, who subsequently sold it. The proceeds from the sale covered Elena’s debt to the collectors, paid off debts to another bank and the management company, and left a remaining balance of 984,124.48 rubles, which was returned to Klimova.

Now, collectors are seeking compensation from the bailiffs for losses incurred during the initial sale. This demand has led to the resumption of enforcement proceedings on debts that were previously settled. According to Adyeva, the collectors have demanded that the bailiffs compensate them for the losses.

The regional press service of the Federal Bailiff Service (FSSP) has responded to inquiries, stating that information regarding enforcement proceedings and their basis can be found on the FSSP’s official website in the “Bank of Enforcement Proceedings Data.” The press service did not directly address questions about why proceedings were resumed or comment on the lawyer’s claim that the UFSSP should compensate for losses if the court finds the bailiffs at fault.
