The Shcherbinsky District Court of Moscow has ruled that Pobeda airline must increase the permitted dimensions and weight of hand luggage. The decision follows a claim filed by the Moscow Transport Prosecutor’s Office.
The court found Pobeda’s existing restrictions on free hand luggage and duty-free shop items to be unreasonably small. The airline now has one month from the date the court decision enters into force to update its baggage transportation rules.
The prosecutor’s office argued that Pobeda abused its right to determine hand luggage dimensions, creating unacceptable conditions for passengers. They pointed out the extremely small dimensions allowed for free hand luggage (up to 43630 centimeters) and duty-free items (up to 10105 centimeters).
While Pobeda representatives cited Federal Aviation Regulations No. 82, stating that the airline must ensure safe baggage placement and allow for carriage of certain items above the norm, the court referenced a 2018 Supreme Court clarification. This clarification stated that aviation rules must be applied in good faith and with reasonableness.
As a result, Pobeda is now required to increase the free hand luggage allowance to 363027 centimeters and a weight of at least 5 kg. Duty-free shop items packaged in sealed bags must have dimensions of at least 24*32 centimeters.
