Draft Law on the Judicial Council Attached to E-Government with Venice Commission Opinion Received

The draft law on the Judicial Council is now undergoing e-Government procedures, with the Ministry of Justice having received feedback from the Venice Commission. The Ministry views this as a crucial step toward enhancing the independence and transparency of the judiciary.

The Venice Commission’s opinion is considered constructive and substantial, offering clear guidelines and recommendations, particularly in areas where the Ministry has focused its efforts. The Ministry affirms that these recommendations have already been taken into consideration.

The Commission’s recognition of the transparent and inclusive drafting process, which included public debates, expert consultations, and the involvement of all key stakeholders, is particularly important. According to the Ministry, this confirms that the reforms are aligned with European standards and contribute to increased confidence in both the legislative process and the judiciary.

The proposed law introduces several key changes, including greater transparency in the process for dismissing the president or deputy of the Council. The law also clarifies the criteria for selecting “distinguished lawyers” and mandates public hearings for candidates for non-judicial member positions. Furthermore, the new law strengthens the criteria for the selection, accountability, and dismissal of judges serving on the Council, aligning the overall legal framework with EU recommendations.

The Ministry of Justice highlights that the new law will, for the first time, establish an objective assessment of the work of council members, ensure transparency in decision-making, and create accountability mechanisms for the members themselves. The Ministry states that they are directly addressing a key point raised by the EU Screening Mission with these changes. The Ministry anticipates the draft law on the Judicial Council will soon be adopted by the Assembly as planned.
