Schiphol Airport’s Environmental Permit Revoked by Court

The Hague court has revoked Schiphol Airport’s environmental operating permit, potentially requiring the airport to apply for a new one. The ruling casts uncertainty over the airport’s operations and could lead to lengthy delays.

The court sided with campaign groups who argued that the permit, controversially awarded in 2023, was improperly granted because Schiphol failed to adequately demonstrate that its emissions remained within agreed limits. Judges found that the permit application was poorly prepared and lacked sufficient justification.

The case highlights ongoing concerns about nitrogen emissions from major polluters. Since 2019, companies producing significant nitrogen emissions in the Netherlands have been required to hold operating permits specifying their allowed discharge levels. Schiphol had been operating without a permit for years before finally receiving one in 2023, allowing for 500,000 annual take-offs and landings.

Schiphol acquired nine farms in 2023 to utilize their nitrogen pollution rights, a move that drew criticism. The airport has announced its intention to appeal the court’s decision.

The immediate consequences of the ruling remain unclear. Johan Vollenbroek, chairman of campaign group MOB, is considering seeking an enforcement notice if the airport continues operating without a valid permit.

This legal challenge adds to a series of battles facing Schiphol. In March, over 900 individuals joined a lawsuit accusing the airport of mishandling or neglecting their health.
