Deportation of Rooted Children and the Violation of Children’s Rights

Three siblings, Isaac (16), Sarah (11), and Rejoice (7), were deported to Nigeria with their mother after residing in the Netherlands for nine years, raising concerns about children’s rights and the impact of Dutch migration policy. The deportation occurred despite previous protections offered by a pardon, which was later abolished with promises of faster residency procedures.

The family’s deportation highlights the potential dangers faced by children after forced return. Research indicates that these children often experience mental health issues, precarious living conditions, and difficulties integrating into their new environment.

The case of Isaac, Sarah, and Rejoice raises questions about whether their individual rights were considered during the deportation process. Nigeria is currently facing a severe economic crisis, with high rates of poverty and crime, creating a risky environment for returning individuals. The Ministry of Foreign Affairs has even issued a negative travel advisory for Nigeria, citing safety concerns.

Experts argue that Dutch migration policy increasingly disregards the United Nations Convention on the Rights of the Child. The convention emphasizes the importance of considering the child’s opinion, identity, family situation, safety, vulnerability, education, and access to healthcare in return decisions.

Advocates are calling for a fundamental change in migration policy to better protect children’s rights. They propose implementing a children’s rights test and prioritizing the child’s best interests in all return decisions, as well as incorporating a developmental perspective into return plans. This approach is seen as essential for ensuring the sustainable return of children and preventing them from becoming victims of a system that fails to adequately safeguard their rights.
