TV 2 Ordered to Release Raw Footage from “The Black Swan” Documentary

TV 2 has been ordered to release specific raw footage from its documentary series “The Black Swan” following a ruling by the Eastern High Court. The footage is potentially relevant to a disciplinary case against lawyer Nicolai Dyhr.

The decision upholds a previous ruling from the Court in Lyngby, prompting TV 2 to seek an appeal to the Supreme Court.

Lawyer René Offersen, representing Nicolai Dyhr, requested access to the material for Dyhr’s defense before the Disciplinary Board for Lawyers. Dyhr faces nine charges, including one related to his appearance in “The Black Swan,” where he was secretly filmed making allegedly inappropriate statements to business lawyer Amira Smajic.

Dyhr denies any wrongdoing, claiming he was enticed by TV 2’s undercover operative and that no client advice was given to Smajic.

TV 2’s editor-in-chief, Michael Nørgaard, emphasized the case’s importance of principle, stating that TV 2 safeguards its editorial content and disagrees with the High Court’s decision. The station has applied for permission to appeal to the Supreme Court.

The Appeals Permission Board must grant permission for the case to be heard by the Supreme Court.

TV 2 faces similar requests for internal material in two other cases. The National Unit for Special Crime (NSK) was previously denied broad access to raw footage from TV 2 and Wingman, the production company behind “The Black Swan,” by the Court in Glostrup. The Copenhagen City Court is scheduled to rule next week on a request from the lawyer representing Lise Roulund, another lawyer secretly recorded in the documentary. Roulund is facing criminal charges, with some of the allegations related to the content of the TV footage.
