Supreme Court to Review Conviction for Racist Jokes

The Supreme Court will review the conviction of a man found guilty of making a series of racist jokes targeting Jewish and Black people. This decision was announced on the Appeals Permission Board’s website.

The case stems from a series of statements categorized as “Jew jokes” and “Nigger jokes.” The lower courts, specifically the Court in Holstebro and the Western High Court, had previously ruled that these statements violated the limits of the penal code.

The High Court determined that a total of 50 statements were degrading and insulting, thus violating the penal code’s racism paragraph. This paragraph is designed to protect groups from insults, threats, or degradation based on their skin color, religion, or other characteristics.

In February, the High Court sentenced the 29-year-old man to seven days in prison. He had previously sought an acquittal.

The High Court judges were not unanimous in their decision. However, a majority of five out of six judges agreed that the jokes ridiculed Jewish people in relation to the Holocaust. They also found that Black people were described in derogatory terms, such as slaves, worthless individuals, and criminals.
