Man Sentenced to Prison and Deportation for Rape on Train

A 33-year-old man has been sentenced to two years and six months in prison for raping and indecently exposing himself to a 16-year-old girl on a regional train traveling between Køge and Østerport in January. He will also be deported from Denmark and barred from re-entering the country for six years.

The ruling was delivered on Friday in the Court of Roskilde.

The prosecution stated the man assaulted the girl in multiple locations on the train, with the rape itself occurring in the train’s toilet. The court determined this to be proven and convicted him as charged.

The incident occurred on a regional train heading towards Østerport on January 7th, shortly after noon. Both the 33-year-old man and the 16-year-old girl boarded the train at Køge Station.

The man, who does not speak Danish, testified through an interpreter that he initiated a conversation with the girl near one of the station’s departure boards. An eyewitness reported seeing the girl enter the carriage and seemingly signal to the man, who then sat next to her. Shortly thereafter, the man began touching and kissing her.

The girl, who was 16 at the time of the incident, was wearing a sunflower lanyard, which indicates invisible disabilities such as developmental disabilities or cognitive difficulties. The man claimed he did not notice the lanyard.

In closed-door testimony, the girl stated that the man initiated the sexual activity and that she did not give her consent. She also explained that she attempted to escape, but the man followed her through the train and locked them both in the toilet, where he assaulted her.

The court found the girl’s account to be credible due to her detailed descriptions and the physical evidence found on her trousers.

The man claimed that the girl pulled him into the toilet and performed acts on him that he did not want. “I froze completely and didn’t know what to do. I couldn’t resist her,” he stated during the trial. The court did not find it believable that the 16-year-old girl was capable of such actions.

The 33-year-old man is appealing the case to the High Court.
