FK Distribution Found to Have Abused Dominant Market Position

The Maritime and Commercial High Court has ruled that FK Distribution, a major distributor of physical advertising brochures, abused its dominant market position. This decision, announced in a press release by the Danish Competition and Consumer Authority, upholds a previous ruling against the company.

The case centers around FK Distribution’s actions after PostNord, a competitor, ceased distributing physical advertising brochures. FK Distribution subsequently introduced a condition requiring customers to purchase digital advertising displays on its platforms, including minetilbud.dk, along with physical brochure distribution.

According to Tine Rønde, Deputy Director of the Danish Competition and Consumer Authority, “This condition was likely to restrict competition and was illegal,” hindering competitors operating digital advertising platforms.

FK Distribution, part of the publicly traded North Media, had previously stated its intention to appeal an earlier decision by the Competition Council in 2020, which reached the same conclusion. At the time, the company asserted that the case was “a matter of principle” and expressed confidence in a successful appeal.
