Bodum Loses Copyright Case Over Cup Design to Royal Copenhagen

The Eastern High Court has upheld a previous ruling that Bodum’s “Douro” cup infringes upon the copyright of Royal Copenhagen’s “Contrast” cup, ordering Bodum to recall and destroy the infringing product. The decision concludes a legal battle between the two companies over the design of a fluted coffee cup with a silicone grip.

Fiskars, the owner of Royal Copenhagen, has been awarded 100,000 kroner in compensation. The court found significant similarities between the two cups, leading them to conclude that Bodum’s design was an intentional imitation.

Bodum argued that the design of their “Douro” cup was inspired by the “cultural-geographical landscape contours in the Portuguese wine valley around the Douro River”. However, the court sided with Fiskars, agreeing that the “Douro” mug was an imitation of the Royal Copenhagen “Contrast” cup.

The High Court’s judgment stated that the similarity between the cups is so significant that it must be considered intentional and poses a considerable risk of confusion among consumers. This confirms the initial decision made by the Maritime and Commercial High Court last year.
