Supreme Court Finds Copenhagen Police Violated Human Rights During Strip Search

The Supreme Court has ruled that Copenhagen Police officers violated a man’s human rights during a strip search conducted in May 2021 prior to his detention. This decision was outlined in a case summary released by the court on Thursday.

The incident involved a forceful search where multiple officers restrained the man and removed his clothing. The Supreme Court determined that the police failed to provide adequate justification for the necessity of such intrusive measures.

Specifically, the court concluded that the search contravened Article 3 of the European Convention on Human Rights, which prohibits degrading treatment. This assessment differed from the High Court’s earlier opinion.

Both the High Court and the Supreme Court concurred that the man’s administrative detention exceeded the permissible duration. He was detained from 7:55 PM to 9:05 PM, and the courts agreed that his detention should have ended by 8:10 PM.
